Policies and Procedures

The Bay Area Air Quality Management District's Compliance & Enforcement Division has developed a Policies and Procedures Manual to provide guidance to District Enforcement staff and to promote self-auditing/compliance and pollution prevention among affected businesses. The manual is also to be used as a reference in resolving questions regarding particular inspections, answering questions from the public and providing training to new inspectors.

This manual is not a rulebook. The Bay Area air Quality Management District is authorized by stated law to adopt and enforce rules and regulations to achieve and maintain air quality standards. Those rules are set forth in the Rules and Regulations adopted by the District's Board of Directors. Ultimately, all questions regarding compliance must be answered by referring to District Rules and Regulations, to rules of the California air Resources Board, and to state and federal law.

These guidelines are intended to provide staff with standardized procedures. District staff may deviate from these guidelines following approval from District management. The guidelines do not modify District regulation or other applicable law, and do not create binding requirements on the Air Pollution Control Officer or any entity outside the District. In the event of a conflict between these guidelines and District regulation, the latter will govern.

This Policies and Procedures Manual will be expanded as new guideline documents are completed or revised. Those documents that are currently available electronically are listed below. Some, not all, guidelines may undergo a public comment period before final release. They will be posted in the "Public Notice" section of this website. Users may subscribe to the District's email notification of changes to this website, which will include announcements of any guideline documents opened for public comment.
