Regulation 5: Open Burning - Under Development

Learn about the Air District's development process for amending Regulation 5: Open Burning.

Find out about the status and anticipated timeline of the rule development process. Information on hearings, workshops, and other events is provided below, along with supporting documents and materials.

The Air District is developing amendments to Regulation 5 to exempt public agencies from paying Open Burning Fees when conducting prescribed burns for the purpose of wildfire prevention. This effort is part of the Air District's comprehensive Wildfire Air Quality Response Program, which is intended to prepare, prevent, and respond to future wildfires.

On July 24, 2019, the Air District will host a public workshop on proposed amendments to Regulation 5 (Open Burning) and Rule 6-3 (Wood-Burning Devices) as part of the Wildfire Air Quality Response Program. For details on the workshop, see the Events section of this page.

The Air District will release draft amendments to Regulation 5 and a workshop report and will be accepting comments on these materials through August 12, 2019.
